What Is Fair Use?
Fair Use is the allowance made for the use of copyrighted material for the purpose of commentary, criticism, or parody. This section discusses the legal framework for Fair Use and the specifics of when Fair Use does and does not apply.
Copyright Is a Restriction on Free Speech
In the United States, we have a constitutionally guaranteed right to Freedom of Speech and also of the Press. At its most basic, this means that you can say, write, or publish anything you want to and the government is not supposed to be allowed to do anything to restrict that. However, we know that this is not completely true. Certain forms of speech are restricted because society has determined that the benefit of restriction far outweighs the infringement on freedom. For example, fraudulent advertising, libel, false accusations, and other types of lying are considered criminal behavior. The classic example of yelling “Fire!” in a crowded theater falls into this category. These are restrictions on free speech put in place to protect the public from certain types of harm. Copyright functions similarly, except it doesn’t protect from harm. Rather, it promotes a benefit — artists having control over their work and being able to profit from it.
The restriction occurs because if someone had absolute freedom to publish whatever they wanted, that would include the ability to publish something originally written by someone else. The benefit of artist control comes at the cost of a restriction on freedom. However, the restriction carries its own costs which may be harmful to society.
Fair Use Restores Lost Benefits
Fair Use is a solution to this problem. It exempts certain types of uses from the restrictions of copyright in order to recover the benefits of Free Speech.
Fair Use allows you to make copies of a copyrighted work for the purpose of comment, criticism, or parody. In some ways, it might have made sense if this had been called “Fair Mention,” because the circumstances where the exemption applies are really cases of mentioning the work, rather than using it.
Fair Use is a gray area. There are no bright line tests that definitively determine whether a usage is Fair Use or infringement. There is, however, a four-fold list of criteria that judges are directed to use when determining whether a specific instance is Fair Use or not.
The four criteria are:
• The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.
• The nature of the copyrighted work
• The amount and substantiality of the portion used in relation to the copyrighted work as a whole
• The effect of the use upon the potential market for or value of the copyrighted work.
Point 1 is probably the most important — the context of the use itself. If you include a copyrighted poem into a collection of poems for sale, that is quite different than including the same poem in an essay about the poem.
Point 2, the nature of the work, is generally understood to deal with issues such as the cultural importance of the work, its newsworthiness, and whether it is a published or private work.
Point 3, the amount of the work used, has obvious reasonability. It should be noted, though, that use of a complete work (such as a reproduction of an entire painting) does not disqualify a determination of Fair Use.
Point 4, the market effect, is second in importance only to Point 1. A perfect copy of a work thinly disguised as a commentary may divert sales away from the original.
On the other hand, an excerpt included in a positive review may increase the work’s value. This criterion has everything to do with the extent to which the usage can serve as a substitute for the original work. Negative criticism that adversely affects market value can still be Fair Use.
Fair Use Is Gray
It cannot be stressed enough: fair use is a gray area. There are some uses that are clearly Fair, and some that are clearly infringement, but ultimately Fair Use is determined by a judge if and only if a case is brought to trial, which rarely happens.

Linking to a News Story: If you link to a news story or a blog post from your own site, it is customary to include a quote or two from the source material. In this case, the context of your link to the original material probably constitutes commentary, and the quotes are covered under Fair Use.
Things That Are Definitely Not Fair Use
Using an Image From Google to Illustrate a Blog Post:
It is very popular today to illustrate blog posts and other online stories with images that capture the themes of the story, even though they aren’t always directly related. Using a quick Google Image Search and pulling any image you find on to your blog is likely going to infringe on copyright, unless the image itself has an Open License. It does not count as Fair Use, because you are using the image to illustrate your post, not commenting on the image itself.
Quoting All or Most of a News Story:
Quoting a few lines of a news story in order to provide some context to a link is just fine, but what about copying the whole thing? That’s infringement.
So where’s the line between infringement and Fair Use in a case like this? Can you post half the story? Ten percent of it? There isn’t an obvious line. It isn’t as if there’s a specific word limit or article percentage that makes the difference. The best question to ask yourself in a case like this is whether your post will realistically function to send traffic to the original post, or if it is substantial enough to act as a replacement for it. If your post effectively replaces the original, then it isn’t Fair Use — it’s infringement.
Courts consider actual and statutory damages when making an award in a case that proved copyright infringement.

A plaintiff in an infringement action may opt for either actual damages (and the infringer’s profits, if appropriate) or statutory damages, but not both. It is often said that copyright plaintiffs must "elect their remedy." Statutory damages are explained in 17 U.S.C. § 504(c). For infringements that cannot clearly be proven as either innocent or willful, statutory damages may be from $750 to $30,000 per infringement. The exact amount depends on the seriousness of the infringing act and the financial worth of the infringer.
On the other hand, an innocent infringer may have to pay as little as $200, while an intentional infringer may have to pay as much as $150,000 for a single infringement of one work. In short, statutory damages provide a clearly defined remedy for victims of infringement without the murkiness and uncertainty of the first two categories of damages.
After last year's Supreme Court decision in Kirtsaeng v. John Wiley & Sons, Inc., courts should now give substantial weight to the objective reasonableness of the losing party's position in analyzing fee requests. 136 S. Ct. at 1983. The Kirtsaeng court tempered this admonition by cautioning that "objective reasonableness can be only an important factor in assessing fee applications - not the controlling one." Id. at 1988. "That means in any given case a court may award fees even though the losing party offered reasonable arguments (or, conversely, deny fees even though the losing party made unreasonable ones)." Id. "Although objective reasonableness carries significant weight, courts must view all the circumstances of a case on their own terms, in light of the Copyright Act's essential goals." Id. at 1989.

A rebellion against the high cost of a bachelor’s degree, already brewing around the nation before the coronavirus, has gathered fresh momentum as campuses have strained to operate in the pandemic. Incensed at paying face-to-face prices for education that is increasingly online, students and their parents are demanding tuition rebates, increased financial aid, reduced fees and leaves of absences to compensate for what they feel will be a diminished college experience.
Universities have been divided in their response, with some offering discounts but most resisting, arguing that remote learning and other virus measures are making their operations more, not less, costly at a time when higher education is already struggling.
The roster of colleges that have rescinded plans to reopen their classrooms has been growing by the day. In the past two weeks, the University of Maryland, the University of Pennsylvania, the University of Southern California, the University of Virginia, Princeton, and a host of other colleges announced plans to hold all or most of their classes online, citing concerns about the coronavirus.
Moody’s Investors Service, which in March downgraded the higher education sector from stable to negative, wrote that even before the pandemic, roughly 30 percent of universities “were already running operating deficits.”
Will Andersen, an 18-year-old incoming freshman at the University of Wisconsin, put it this way: “Who wants to pay $25,000 a year for glorified Skype?”
Most colleges have kept prices flat, and a few have even increased them. They can’t afford to do otherwise without mass faculty layoffs, said Robert Kelchen, a Seton Hall University associate professor of higher education, even though the isolated, monitored experience campuses are selling this fall “is going to feel like some combination of a monastery and a minimum-security prison.”
“This crisis is demonstrating that there is real value in face-to-face instruction,” agreed David Feldman, an economist at William & Mary. That recognition, he said, will generally protect better-endowed schools and those with state support. Even so, he said, a culling is at hand for higher education. His prediction: a consolidation of public university branch campuses and a reckoning for some small, private liberal arts colleges that are already operating on thin margins.
“There will be a shakeout,” he said.

A week into the fall semester, the University of Notre Dame announced on Tuesday that it would move to online instruction for at least the next two weeks in an attempt to control a growing coronavirus outbreak, and could move to shut down campus entirely.
“If these steps are not successful, we will have to send students home, as we did last spring,” Notre Dame’s president, the Rev. John I. Jenkins, said in a video address to students, noting that he had been inclined to take that step before consulting with local health officials.
The announcement came as universities across the country are struggling to control fast-growing outbreaks among returning students. On Monday, the University of North Carolina at Chapel Hill moved all of its undergraduate classes online, also a week into the fall semester. And Michigan State on Tuesday shifted its reopening plans, telling students not to return for the start of classes in two weeks.
At Notre Dame’s campus near South Bend, Ind., 12,000 undergraduate and graduate students were tested before they could return to campus on Aug. 3 to start classes a week later. The few dozen who tested positive were told to stay home. Yet by Tuesday, the school reported that at least 147 people had tested positive for the virus over the last two weeks. The Princeton Review Reports Findings of Its Survey of College Administrators on Fall 2020 and Its Annual College Rankings in "The Best 386 Colleges"
NEW YORK, August 18, 2020 — According to a Princeton Review® survey that recently polled administrators at schools featured in the company's just-published book, The Best 386 Colleges, the top priority among college administrators for the upcoming school year is "social distancing: maintaining health and safety on campus." The issue administrators ranked as likely to be the greatest concern among students is "financial aid."
Findings, based on surveys of administrators from 179 colleges (130 private and 49 public schools) who submitted their responses online between July 1 and July 22, reveal:
• Nearly 4 of 10 respondents (39%) reported their projected fall enrollment is down from 2019, while 19% reported an increase; 42% said it is about the same.
• Just over 1 in 8 respondents (14%) reported the percentage of in-state students in their school's incoming first-year class is higher than it was in 2019, while 6% reported it is lower than it was in 2019.
• More than 9 out of 10 (93%) reported their schools were making COVID-19–related modifications in classrooms, labs, residence halls, and dining halls.
• Two-thirds (67%) anticipated the majority of their fall courses would be principally hybrid (part in-person, part online) classes: 21% said in-person and 12% said online.
"COVID-19 has presented sobering challenges for school administrators and educators, as well as daunting decisions for students and their parents," said Robert Franek, Editor-in-Chief at The Princeton Review. "What impressed us in our administrator survey findings is the flexibility many colleges built into their reopening plans, especially those giving students options to study remotely or on campus with health and safety protocols in place. Hundreds of colleges announced early this summer they would be reopening for in-person instruction this fall. As start dates near, many backtrack, citing a worsening health crisis.
Hundreds of colleges have reversed or altered their reopening plans in the past several weeks after taking stock of COVID-19 testing availability, student and faculty safety concerns, state regulations and the worsening public health crisis.
Through May, June, and July, many colleges announced in-person reopening plans that included social distancing protocols, mask-wearing requirements, low-density living arrangements and regular testing for students and employees. Many colleges planning to bring students back to campus for the fall semester have reversed course entirely and opted for online-only instruction.
Chapman University in southern California announced recently that it would begin the fall semester with online instruction. "These are very expensive propositions for universities," said Daniele Struppa, president of Chapman. "Between lost revenue and additional expenditures, we are looking at a deficit of $100 to $110 million. So that's a significant amount of money."
Miami University in Ohio has also delayed in-person start dates, among many others.
Benjy Renton has been tracking colleges' plan reversals and alterations since the University of Southern California announced in early July that a majority of undergraduate instruction would be held online. Renton has focused on tracking two trends: when colleges announce changes and where colleges are announcing changes.
Peer institutions in similar geographic areas tend to follow each other's lead, he said. For example, in Washington, D.C., George Washington University announced July 27 that it would reverse its plans and conduct all instruction online in the fall. Georgetown University followed suit two days later, and American University announced the same on July 30.
Location has also played a role. New Jersey for example has strict requirements about what conditions need to be met before colleges can reopen. The College of New Jersey, Princeton University, Saint Peter's University, and Rowan University are conducting all or nearly all classes online.
If colleges do bring students back, Renton is not optimistic about how long they will be able to stay open in-person this fall. He compares residential campuses to aircraft carriers, cruise ships, and nursing homes -- situations where people live in close proximity.
"All the ones that we've seen just don't go well. Theoretically, all the science is telling us no," Renton said.
